2. Nature of the Service — Assistive Tool

Selio AI is an assistive tool based on artificial intelligence, designed to support sales processes. The Application does not replace and is not designed to replace:

The professional judgment of an experienced sales agent.
Legal, financial, or business consulting.
Professional sales training.
The final human decision in the sales process.

All suggestions, insights, scores, and AI-generated content are indicative and should be treated as such.

3. Limitations of Artificial Intelligence

3.1 Transcription

The transcription feature uses natural language processing models that may produce errors. Transcription accuracy depends on factors such as audio quality, speaker accent, technical jargon, background noise, and conversation language. Transcriptions should not be considered official records or legal documents.

3.2 AI coaching and suggestions

Real-time coaching suggestions are estimates based on pattern matching and language models. They may be:

Inaccurate or irrelevant to the specific context of the conversation.
Based on misinterpretations of the speaker's tone or intent.
Not adapted to the specifics of your industry or market.

The user always decides whether and how to apply AI suggestions.

3.3 Lead Scoring

Lead qualification scores (0-100) are probabilistic estimates generated by an automated dimensional model. They:

Are not definitive assessments of sales potential.
May vary significantly depending on the quality and quantity of data from the conversation.
Should not be used as the sole criterion for important business decisions.
Are not financial indicators and do not guarantee sales results.

3.4 Auto-generated content

Follow-up emails, summaries, and other auto-generated AI text must be reviewed and approved by the user before being sent or used. The Company is not responsible for content sent by the user without adequate review.

4. Conversation Recording

4.1 User's legal responsibility

Laws regarding telephone conversation recording vary significantly between jurisdictions. Some jurisdictions require the consent of all parties (including California, USA), while others allow recording with only one party's consent.

The user is solely responsible for:

Knowing and complying with the applicable legislation in their jurisdiction and the jurisdiction of their conversation partner.
Informing all parties involved in advance that the conversation will be transcribed.
Obtaining explicit consent where the law requires it.
Immediately stopping transcription at the request of any party.

4.2 Disclaimer of liability

Nova Carpathians Creations S.R.L. bears no responsibility for the use of the transcription feature in violation of conversation recording legislation in any jurisdiction. Any legal consequences of such use are the sole responsibility of the user.

5. Availability and Performance

5.1 No guarantee of availability

While we strive to keep the Service functional, we do not guarantee continuous, uninterrupted, or error-free availability. The Service may be affected by:

Planned interruptions for maintenance or updates.
Issues with third-party infrastructure providers (Supabase, OpenAI, ElevenLabs, Google).
Internet connectivity problems.
Factors beyond our control.

5.2 Third-party service dependency

Selio AI functionality depends on the availability of third-party services (transcription, AI, database). Unavailability of any of these services may partially or fully affect application operation. We are not responsible for interruptions caused by third-party providers.

6. Security

We implement technical and organizational security measures in accordance with industry standards (encryption, multi-tenant isolation, role-based access control). However, no computer system is completely immune to security risks. We cannot guarantee absolute security against all cyber threats.

The user is responsible for:

The security of their own access credentials (password, tokens).
The security of the device on which the application runs.
Promptly reporting any suspicion of unauthorized access.

7. Limitation of Liability

7.1 "As is" Service

Selio AI is provided "as is" and "as available." To the maximum extent permitted by applicable law, the Company:

Makes no express or implied warranties regarding the accuracy, completeness, or usefulness of AI suggestions.
Does not guarantee specific sales results as a consequence of using the application.
Does not guarantee the accuracy of transcription, scoring, or any other AI-based functionality.

7.2 Exclusion of damages

To the maximum extent permitted by law, the Company is not liable for:

Loss of revenue, profits, or business opportunities.
Loss of data (except for data in our direct custody).
Indirect, incidental, special, or consequential damages.
Business decisions made based on AI suggestions or scores.
Consequences of using AI-generated content without adequate review.
Violations of conversation recording legislation by the user.

7.3 Liability cap

The Company's total liability, regardless of the basis of the claim, is limited to the amount paid by the user for the Service in the preceding 12 months.

7.4 Consumer rights

Nothing in this Disclaimer limits your legal rights as a consumer under mandatory legislation in your jurisdiction (including GDPR and EU consumer protection law).

8. Intellectual Property

Selio AI, including its source code, design, algorithms, and documentation, is protected by copyright and intellectual property law. Unauthorized use, copying, redistribution, or reverse engineering of the application is prohibited.

9. Third-Party Links and Services

The Application may contain links or integrations with third-party services (Google, OpenAI, etc.). We are not responsible for the content, privacy policies, or practices of these third-party services. We encourage you to review the terms and policies of each third-party service you use.

10. Updates to This Disclaimer

We reserve the right to modify this Disclaimer. Significant changes will be communicated at least 30 days before taking effect.
